Effective October 1, 2008 the State of Florida revamped their terminology as it relates to the care of children. Specifically, what was previously referred to as ‘custody’ and ‘visitation’ is now known as ‘timesharing’.
In times past, one parent was known as the ‘primary residential parent’ and the other parent was the ‘secondary parent’ however, as of 2008, these labels have been eliminated.
The key terms now in Florida Statute 61.13 are ‘parental responsibility’ and ‘timesharing’. The simple explanation is that parental responsibility is the decision-making aspect whereas timesharing is the schedule of when the child(ren) will spend their time between the Mother and Father.”
